Tier 3: Obtaining PHI for personal gain or with malicious intent – Up to 10 years in jail. It may also be possible for a CE or BA to receive a civil penalty for unknowingly violating HIPAA if the state in which the violation occurs allows individuals to bring legal action against the person(s) responsible for the violation.
