A recent incident involving Arkansas-based MedEvolve serves as a reminder of the consequences that arise from the mishandling of PHI and the importance of healthcare businesses ensuring that they and their business associates are HIPAA compliant.
The HIPAA Violation
On May 16, 2023, the HHS Office for Civil Rights announced the resolution of a HIPAA investigation into MedEvolve, a business associate based in Arkansas. The investigation was initiated following an unlawful disclosure of PHI due to an unsecured server, potentially impacting over 350,000 individuals. The settlement highlights the importance of maintaining robust security measures and adhering to HIPAA requirements in safeguarding patient data.
The Impact on Patient Privacy
The improper disclosure of PHI can have severe consequences for patients, ranging from identity theft to emotional distress. In this particular case, the unsecured server exposed sensitive information, including names, addresses, medical diagnoses, and insurance details. Such breaches violate patients’ trust, compromise their privacy, and expose them to potential harm.

Under HIPAA, both covered entities (such as healthcare providers and health plans) and their business associates (third-party vendors who handle PHI) are responsible for maintaining the security and privacy of patient data.
